The UW Athletic Department reserved any further comment Monday on a lawsuit by former Badger hockey player Alex Leavitt.
Leavitt's attorneys filed the suit Friday asking for $250,000 from each of four defendants, UW Hockey Coach Mike Eaves, UW Athletic Director Pat Richter, Senior Associate Athletic Director Cheryl Marra and the UW Athletic Department.
The suit stems from an altercation between Eaves and Leavitt in a North Dakota hotel room Nov. 23. The lawsuit claims Eaves \physically and verbally assaulted and battered"" Leavitt, verbally berated him and damaged his shirt and watch.
One of Leavitt's attorneys, Richard Westley, said Monday they will let the legal process take its course but will not rule out a settlement. However, Westley speculated the athletic department is not interested in a settlement because they did not respond to a notice of claim the attorneys filed in March.
A notice of claim gives information about what a plaintiff maintains happened in an incident and is required before anyone can sue a state employee, Westley said.
Spokesperson Steve Malchow said the department had no further comment other than the statement it previously released in support of Eaves.
